KANSAS CITY, Missouri – David L. Biersmith, owner of Industrial Medical Centers (IMC), has plead guilty to one count of health care fraud and one count of making false statements to a federal agency.
Biersmith’s clinic was located along the Truman Road Corridor for many years, until it moved to Independence about three years ago. Biersmith held no medical license, but his clinic provided DNA and drug testing through contractual agreements with a variety of area entities. The clinic also provided medical services to patients, as well as drug testing and physical examinations for drivers of commercial motor vehicles.
According to Tom Larson, Acting U.S. Attorney for the Western District of Missouri, Biersmith signed a contract with Logistics Health, Inc. in April of 2013 to conduct disability exams for veterans. The examinations were intended to determine the impairments of veterans and assess their potential eligibility for benefits. While the examinations were initially conducted by a licensed physician, Biersmith declined to replace the individual with another licensed physician when they left in July of 2013. Instead, Biersmith tapped a former physician who had lost his medical license, 74-year-old Wayne W. Williamson, to perform the exams. Williamson pleaded guilty to health care fraud in January 2017 in a separate but related case.
Biersmith was one of the founders of the Truman Road Corridor Association and was active in area civic and political causes. If convicted he could be sentenced to 15 years in federal prison.
