After several weeks of fighting to remain on the ballot for the 3rd District City Council seat, Michael Fletcher has lost the battle.

A three-judge panel of the Missouri Court of Appeals decided Monday to uphold Jackson County Judge Ann Mesle’s ruling to disqualify Fletcher from the race.

Mesle ruled that Fletcher could not claim residency in California for the purpose of court proceedings there while claiming residency in Kansas City, Mo., to run for the city council race.

As a result, she disqualified him from the race citing judicial estoppel.

Kansas City’s charter requires a candidate to live in Kansas City two years immediately prior to election day and live in the council district at least six months prior to the election.

Instead of appealing to the Missouri Supreme Court, Fletcher said he will organize a petition drive to recall the winner of the March 22 3rd District City Council race between Sharon Sanders Brooks and Jermaine Reed.
